Dear
Darryl Taylor,
I
received letter from you this morning, following a letter from
Nathan O’Reilly dated 14th April 2008, which arrived on 16th April 2008,
plus a telephone call from one of your colleagues on the same morning.
I have already exchanged E-mails with Simon Lock and Craig Graham, of
your company, that included sending them a text of a letter I posted to
Frances Orozco of Tiscali Customer Services; attached below the sign
off.
The details they asked me to forward are as follows:
Your Ref: *******
Creditor: Tiscali
Client Ref: UI********
As explained to them, I sent a cheque to Tiscali back in March, just
before we went on holiday. I sent another cheque to Frances Orozco last
week, just in case the first was lost in the post; that was posted two
days after I received a letter from Frances Orozco advising me of the
final following me discontinuing services with Tiscali; cutting my
involvement to “Dial Up” only.
Your letter was dated 18th April 2008; two days after that
exchange of E-mails.
Is it your intention to keep threatening me until I pay your company a
sum of money that has already been sent to Tiscali? The first of those
cheques was sent over six weeks ago.
What is the legal basis, or justification, for obtaining money by
threat, especially when it is not owed, has already been paid? I am
interested from the point of view of using this material in business
experiences presentations I have been invited to make, as well as for
what is beginning to look like an inevitable call for advice to my local
Chamber of Commerce legal team on this whole Tiscali debacle.
